HOA Legislation
It is our business to keep abreast of the national, state and county legal landscape and changes in the laws governing home owner associations. When legal issues arise, we work with your association's attorney to help educate and guide your board of directors regarding any changes in legislation that may or will affect your community.
Certain states are pushing for more accountability on the part of HOAs when it comes to bylaw infraction enforcement. The North Carolina Planned Community Act, for example, requires a due process hearing to be held before any homeowner may be fined for a covenant violation. It also limits the amount of the fine and sets other restrictions.
The "Green Movement" has begun to drive legislative initiatives that your community should keep abreast of. As a case-in-point, the North Carolina General Assembly recently adopted changes to HOA statutes affecting a homeowner's use of solar collection devices.
